On December 19, 2025, Google announced a lawsuit accusing SerpApi of "unlawful scraping" of search results and alleged violations of the Digital Millennium Copyright Act by bypassing security measures designed to protect copyrighted content embedded in search result pages. Google says SerpApi's bots evade its protective systems and scrape content at scale, then resell that data to third parties.
The official blog post by Google's general counsel frames the issue as one of copyright and security: a smaller company purportedly circumventing directives and protections that sites and rights holders set for how their content should be accessed.
Google stresses that it honors website crawling directives and insists SerpApi ignored these, using techniques such as cloaking, bot networks and fake identities to harvest data. It also emphasizes that some scraped material is licensed content from third parties, such as images in Knowledge Panels or data in shopping features.
Why This Looks Odd to Site Owners and SEOs!?
From the perspective of people whose job it is to understand how search works, there are so many reasons this lawsuit feels inconsistent with Google's long history of scrapping and business model.
Google's Business Model Is Built on Web Scraping
Google crawls billions of pages continuously to index and serve content without prior consent and then sells advertising against that data. Nothing prevents Google from collecting text, links, images or structured data from public websites to build search indexes. That is the foundation of search SEO, and the web.
Yet now Google says that another company doing automated extraction of it's website crosses some ambiguous line of "unlawful" behavior. This raises questions:
- If crawling is legitimate, where exactly is Google drawing the line between allowed crawling and disallowed scraping?
- Why is a company that built its empire on extracting web content and selling ads against that content, now presenting itself as a protector of webmasters' rights?
Site owners generally have limited direct control over how their content appears in search and site scraped by AI crawlers daily. The tools are blunt: robots.txt, noindex tags, structured data, sitemaps. Google uses these signals to decide indexing but also creates features (like AI summaries, overviews, snippets, images) that reuse website content in new ways. Additionally Google has insisted that it could index websites WITHOUT crawling them and behind robots.txt blocks without violation.
There have been complaints within the SEO community that Google's own use of public content - for things like AI overview boxes and similar features - effectively repackages other people's work without clear credit or click traffic. Google will defend these uses as fair use or as part of serving relevant results. Others see them as a version of automated extraction at massive scale without compensation.
The contradiction some SEOs see is that Google claims to respect directives while repurposing content itself, then uses copyright law to block others from automated collection of search outputs. Is this not the monopoly in action?
More Google Security Issues?
On the other hand, the interesting thing here is that Google says it has been unable to block Serp API directly. Security wise, Google has been having a tricky time of it trying to lock down AdWords ad accounts. There are reports all over the web about ad agencies being targeted with campaigns that acquire Google Ad account access. Further, it points out that while Google has had a modest record of responding to security issues, they seem to have failed at several spots recently. Not only have people lost access to Ad accounts, Googles response to it, is tepid at best, to out-in-out negligence at worst. There is absolutely no way, someone should be able to hack an agency account and take over 1000 subaccounts in seconds. Bluntly, Googles ad account security, is substandard.
That said, we have heard in the past, that Google had the technology to "finger print" is some method (generating unique titles, links, descriptions, faq boxes, html, etc), every Serp they generate.

Playing with Fire? Ya, What if they lose
It may surprise many, but several of the legal issues being discussed here have never been brought up in court before. It was just recently that Robots.txt became a "standard" by any official body on the web. Previously, all attempts to frame a legal argument with "but what about robots.txt" issues, were swatted clean out of court. Secondly, things like "safe harbor", and various forms of "soft license" agreements have never had a clean day in court. Google could be using this simply as a method of setting legal precedent. It is doubtful that SerpAI will have the resources if this drags on very long.
SEO Tools
Many SEO tools (SEMRush, Moz, etal) rely on some form of automated access to search results for rank tracking. Some of those are paid via Google API services. Others like SERP feature tracking, competitive analysis, keyword research and more are not. Historically, these services have had to deal with rate limits, CAPTCHAs, IP blocks and shifting interfaces, but they have not faced this level of legal challenge.
What that might mean:
- Tools that depend on similar access may face legal or technical restrictions.
- Providers might need to shift to official APIs (which are limited and costly).
- Some kinds of competitive analysis could become expensive or unavailable.
The Broader Debate in the SEO Community
Many SEOs and analysts have responded with skepticism about the lawsuit's framing.
Critics argue this looks more like a competitive play or a move to limit independent auditing of search results than a pure copyright protection move. If only Google and its partners can systematically analyze search data, smaller toolmakers and independent researchers will struggle to provide alternative views of how search works.
Others note similarities to other recent scraping-related lawsuits, such as those involving platforms like Reddit, which also targeted SerpApi and others for bypassing technical controls.
In some discussions, industry voices frame this as a moment when data access rights and search transparency collide with corporate control over APIs and interfaces.
What Site Owners Should Watch
For anyone running sites, managing SEO, or building tools that rely on search data, this case could have long term effects:
- SERP Data Access may get restricted by legal rulings, not just technical controls.
- SEO Tools might need to pay more for official APIs or change how they operate.
- Search Transparency could diminish if fewer independent sources can collect or share SERP data.
- Crawling Standards might evolve to distinguish between indexing bots and data extraction services more sharply.
Understanding how Google defines acceptable vs unacceptable access will be crucial as the case unfolds.
